APPLICANT REQUESTS THAT: 

1. Her Retention/Retirement (R/R) Anniversary Date be changed 
from 29 October 1979 to 21 September 1979 to allow two Inactive 
Duty Training (IDT) participation points to be moved from her 
anniversary year ending (AYE) 29 October 1979 to her AYE 
29 October 1980.  

2. She be credited with her Navy Reserve participation points 
accrued in AYE 28 October 1981.

APPLICANT CONTENDS THAT:

This transfer of points will allow her a total of 50 points for 
AYE 29 October 1980 and a satisfactory year of service towards 
retirement.  Her anniversary date should coincide with her 
reenlistment date.

In support of her appeal, the applicant provides copies of her 
Air National Guard/United States Air Force Reserve (ANG/USAFR) 
Point Credit Summary, Report on Individual Personnel, and 
Statement of Service for Naval Reserve Retirement.  

The applicant’s complete submission, with attachments, is at 
Exhibit A.

STATEMENT OF FACTS:

ARPC/DPTS recommends denial.  DPTS states the requested remedy 
is contrary to Title 10, United States Code (USC), Section 
12732.  The applicant served continuously from the time she 
entered active status after a civilian break-in-service on 
29 October 1975 through her 20 September 1981 discharge.  The 
first day in active status set the applicant’s 29 October 
anniversary date.  Moreover, her 21 September 1979 reenlistment 
did not lead to or stem from a break-in-service, and 
consequently did not affect her anniversary date.  Once set, the 
anniversary date would not change unless the Reserve member 
changed components, transitioned from inactive to active status 
or returned to active status from a civilian break-in-service.  
The applicant’s points and years of satisfactory service are 
correctly reflected in her ANG/USAFR Point Credit Summary.  

In regard to the applicant’s request concerning her Navy Reserve 
participation points, they recommend she petition the United 
States Navy.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

On 1 April 2013, a copy of the Air Force evaluation was 
forwarded to the applicant for review and comment within 30 days 
(Exhibit D).  As of this date, this office has received no 
response.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by 
existing law or regulations.

2.  The application was timely filed.

3.  Insufficient relevant evidence has been presented to 
demonstrate the existence of error or injustice.  We took notice 
of the applicant's complete submission in judging the merits of 
the case; however, we agree with the opinion and recommendation 
of the Air Force office of primary responsibility and adopt its 
rationale as the basis for our conclusion that the applicant has 
not been the victim of an error or injustice.  Therefore, in the 
absence of evidence to the contrary, we find no basis to 
recommend granting the relief sought in this application.

THE BOARD DETERMINES THAT:

The applicant be notified that the evidence presented did not 
demonstrate the existence of material error or injustice; that 
the application was denied without a personal appearance; and 
that the application will only be reconsidered upon the 
submission of newly discovered relevant evidence not considered 
with this application.
